ஐ.நா சபை - இனியும் அதை நம்பணுமா ?

இலங்கையில் இறுதிக்கட்ட போர் தொடர்பாக ஐ.நா சபை குழு ஒன்றை அமைத்து விசாரித்தது. மிகவும் எதிர்பார்க்கப்பட்ட அந்த விசாரணைக்குழுவின் அறிக்கை, சில நாள் முன் சமர்பிக்கப்பட்டது- "Report of the Secretary-General’s Internal Review Panel on United Nations action in Sri Lanka, November 2012".
" இலங்கையில் நடந்த போர்.. ஏற்கனவே தெரிந்தது தானே. இதை ஏன் இப்ப எழுதணும் ?"னு கேப்பீங்க.
இது மற்ற விசாரணைக்குழு அறிக்கை போல் இல்லை.
128 பக்க அறிக்கையில் 1)இலங்கை அரசு 2).விடுதலைப்புலிகள் 3) ஐநா சபை, என மூன்று தரப்பையும் விசாரணைக்குழு நார் நாராக கிழித்து உள்ளது...
ஆமாம்.
ஐநா சபை அமைத்த குழு, ஐநா சபையையே மிகவும் கடுமையாக குற்றம் சாட்டியுள்ளது .நம்பவே முடியவில்லை...
விசாரணைக்குழு மீது நம்பக்கத்தன்மை ஏற்பட்டிருக்கு. அதனால் தான் இந்த 128 பக்க அறிக்கையை முழுதும் படித்தேன் . அறிக்கையில் கூறப்பட்டுள்ள முக்கியமான சிலவற்றை மொழி பெயர்த்துள்ளேன்.
அறிக்கையின் முடிவு என்ன தெரியுமா ?

"போர் நடந்த பொழுது ஐநா சபை , இலங்கை அரசை பகைத்துக் கொள்ள விரும்பாததால், மனித உரிமை மீறல்களை தடுக்கத் தவறிவிட்டது."
இந்த அறிக்கை வெளியான பின்பும், ஐநா சபையை நாம் நம்ப வேண்டுமா ?
August 2008 முதல் – May 2009 வரை நடைபெற்ற இறுதிக்கட்ட போரில் இறந்த பொதுமக்களின் எண்ணிக்கை தோராயமாக 40,000 . இது ஐநா சொந்தமாக கணக்கெடுத்தது..
".......number of credible sources have estimated that there could have been as many as 40,000 civilian deaths....."
ஐநா சபை, மனித உரிமைகளை மீறிய விடுதலைப்புலிகளை மட்டுமே தொடர்ந்து எச்சரித்து வந்தது. ஆனால் (அதே தவறை செய்த ) இலங்கை அரசை கண்டு கொள்ளவில்லை.
" ......The UN repeatedly condemned the LTTE for serious international human rights and humanitarian law violations but largely avoided mention of the Government’s responsibility......."
மனித உரிமை மீறிய இலங்கை அரசை ஐநா அதிகாரிகள் ஏன் எச்சரிக்க வில்லை ?
இலங்கை அரசு தவறு செய்ததற்கான ஆதாரம் இல்லையென்று ஐநா மூத்த அதிகாரிகள் மழுப்புகின்றனர். அது பொய். ஆதாரம் இருந்தது.
"......Senior UN officials said this was because information could not be verified. In fact, information had been verified to a good standard; indeed UN statements on LTTE violations, including the killing of civilians and holding civilians hostage, were based on information verified in the same manner......"
"பொது மக்கள் கொல்லப்படுகிறார்கள்" என்று ஐநா அதிகாரிகள் தகவல் சொன்னார்களே தவிர , "இலங்கை அரசு பயன்படுத்திய நாசரக ஆயுதத்தால் தான் கொல்லப்பட்டார்கள்" என்பதை ,தெரிந்திருந்தும் , அதிகாரிகள் தெரியப்படுத்தவில்லை
" Numerous UN communications said that civilians were being killed in artillery shelling, but they failed to mention that reports most often indicated the shelling in question was from Government forces. The UN condemned the use of heavy weapons in general, and some officials appeared to believe that because such weapons were almost exclusively used by the Government that this was a sufficient means of raising Government responsibility."
இலங்கை அரசை பகைத்துக் கொண்டால் , 'மக்களுக்கு மனிதாபிமான உதவிகளை செய்ய இலங்கை அரசு தடுத்துவிடும்' என்ற காரணத்தினால், இலங்கை அரசு செய்த மனித உரிமை மீறல்களை ஐநா மறைத்துவிட்டது. "......the UN almost completely omitted to explicitly mention Government responsibility for violations of international law. UN officials said they did not want to prejudice humanitarian access by criticizing the Government..."
" போரினால் பாதிக்கப்பட்ட பொது மக்களை 'பாதுகாப்பான பகுதி' என அறிவிக்கப்பட்ட இடங்களில் தற்காலிகமாக தங்க வைக்கப்பட்டிருந்தர். அந்த இடங்களையும் , மருத்துவமனைகளையும் இலங்கை ராணுவம், குண்டுகளை வீசி கடுமையாக தாக்கி பல அப்பாவிகளை கொன்றது"
"....From January 2009 onward, Government forces carried out intense artillery shelling which killed or injured many civilians – whether in makeshift IDP sites in the NFZs, at hospitals, or in UN compounds."
"...விடுதலைப்புலிகள், நன்கு அறிந்தே, வேண்டுமென்றே , பொதுமக்கள் வாழும் பகுதிகளுக்கு அருகில், தங்கள் அலுவலகத்தையும், ராணுவ தளவாடங்களையும் வைத்திருந்தனர். அங்கிருந்தே தாக்குதல் நடத்தினர். தப்பித்துச் செல்லும் பொதுமக்களை சுட்டு வீழ்த்தினர்"
" The LTTE wilfully placed their offices and military equipment near IDP sites and civilian installations and fired mortars and light arms from the vicinity of areas with civilians, and it shot civilians who tried to escape."
" 2008 இறுதியில், ஆயிரக்கணக்கான பொதுமக்கள், தங்க இடமும் கழிப்பறையும் இல்லாமல் தவித்தனர்.January 2009 இல் அவர்கள், தங்களை குண்டு மழையிலிருந்து காத்துக்கொள்ள , மண்ணில் குழி வெட்டி பதுங்கி இருந்தனர். March 2009ல் சாப்பாடும், மருத்துவ வசதியும் இல்லாமல் ஆயிரக்கணக்கானோர் இறந்துவிட்டனர்."

“From as early as 6 February 2009, the SLA [Sri Lanka Army] continuously shelled within the area that became the second NFZ, from all directions, including land, sea and air. It is estimated that there were between 300,000 and 330,000 civilians in that small area. The SLA assault employed aerial bombardment, long-range artillery, howitzers and MBRLs [unguided missile systems] as well as small mortars, RPGs [Rocket Propelled Grenades] and small arms fire ...”
2009 மே மாத துவக்கத்தில் , தோல்வியை நெருங்கிய புலிகள், சமாதானத்திற்காக ஐ.நா வை அணுகினார்கள். ஐ.நா வும் தயாராக இருந்தது. ஆனால் இலங்கை அரசு அதற்கு மறுத்துவிட்டது."
"....early May 2009 .....LTTE was nearing total defeat, some of its members contacted senior UN officials to ask for their help in facilitating a surrender........The Chef de Cabinet asked the Government to allow him to fly into the conflict zone to witness a surrender and act as a guarantor of safe passage. The Government refused and the UN believed it could not attempt further follow-up........"
May18 அன்று, விடுதலைப்புலிகளின் மீதம் இருந்த தலைவர்களும் கொல்லப்பட்டுவிட்டார்கள் . "புலிகள் அவர்களுக்குள்ளாகவே தாக்கிக்கொண்டு இறந்துவிட்டார்கள்" என அரசு கூறுகிறது. ஆனால் உண்மையில், அவர்கள் சமாதனத்திற்காக ஆயுதம் ஏதும் இல்லாமல் வெள்ளைக்கொடி ஏந்தி சரணடைய வந்தவர்கள். அவர்களை இலங்கை ராணுவம் கொன்றுவிட்டது
"By 18 May 2009 most of the remaining LTTE leadership was reported killed. The Government claimed they died in armed engagements, possibly at the hands of other LTTE fighters. Other credible sources said many were executed, including some who on the morning of 18 May had crossed into Government-held territory unarmed and with white flags...."
Throughout the final stages of the conflict, Member States did not hold a single formal meeting on Sri Lanka, whether at the Security Council, the Human Rights Council or the General Assembly.
